Energy certificate

As of July 2013, all owners looking to sell a property, apart from the rare exceptions, are required to obtain energy certificate and attach it as a part of the sales contract. Omitting to abide by this law is a violation and can be subject to penalty.

IT IS REGULATED BY LAW THAT AN ENERGY CERTIFICATE SHOULD BE ISSUED WHEN SELLING ANY RESIDENTIAL SPACES OR BUSINESS OFFICES LARGER THAN 50M2 OF USEFUL FLOOR AREA WHICH ARE FUNCTIONAL ALREADY OR COULD POTENTIALLY BE MADE FUNCTIONAL, I.E. FOR ALL RESIDENTIAL/BUSINESS SPACES EVEN SMALLER THAN 50M2 IF LOCATED INSIDE A BUILDING LARGER THAN 50M2 OF USEFUL FLOOR AREA.


THE CERTIFICATE IS NOT MANDATORY ONLY FOR DETACHED BUILDINGS SMALLER THAN 50M2 USEFUL FLOOR AREA.

IF THE BUILDING HAS THE CERTIFICATE FOR AN INDIVIDUAL LIVING OR BUSINESS SPACE SITUATED WITHIN THE SAME BUILDING, ISSUING A SEPARATE CERTIFICATE IS NOT NECESSARY.

Moreover, the certificate is not needed for industrial buildings, workshops, agricultural facilities with low energetic requirements as well as the buildings of temporary nature which have an operational range of two years or less, as well as the buildings intended for religious ceremonies.

When advertising a propery for sale – publishing it in the media, the advertisement needs to state the energy level of the building or its individual operational unit.

The requirement to obtain the energy certificate is duty of the property owner and he is required to present it to the potential buyer. The fines for not obtaining the energy certificate are ranging from 5.000,00 to 10.000,00kn for natural persons and from 15.000,00 do 30.000,00 kn for legal persons. As of 2016, this law also relates to the owners of rental apartments i.e. their properties, and they are required to present the energy certificate to the person taking the property for rent or lease.

Energy certificate is a kind of an identification card of a building, a document which clearly states energy characteristics of a building, its energy condition and performance, the condition and efficiency of the energy system as well as the quality and characteristics of the thermal insulation elements (heating system, joinery and carpentry, wall quality etc.). The certificate is valid for ten years from the issuance.

The goal of the energy certificate is to provide the building's owners, potential buyers or users information about energy characteristics of the building. This information specifically relates to energy characteristics, efficiency of its energy systems as well as the quality and characteristics of the building's envelope.

Residential and non-residential buildings can be classified into 8 energy classes according to the energy scale A+ to G, A+ being the most efficient and G being the least efficient class.

Energy inspection of a building and energy certification is carried out by a person authorised by the Ministry of Construction and Urban Planning according to the Ordinance on persons authorised for energy certification and energy audits of buildings (Official gazette 81/12, 64/13).
